Important Update: Registration Requirement for Contractors and Subcontractors
Starting December 30, 2024, new regulations under Labor Law Section 220-i require all contractors and subcontractors bidding on or performing work on public work projects or private projects covered by Article 8 of the New York State Labor Law to register with the New York State Department of Labor (NYSDOL).
What Does This Mean?
Contractors and subcontractors must obtain a Certificate of Registration from the NYSDOL
- Submitting bids for new projects.
- Beginning work on any covered project.
This requirement applies to public work projects and certain private projects that receive public subsidies or are part of initiatives like renewable energy systems or climate risk-related projects, as outlined in Article 8 of the Labor Law.
Key Definitions
- Contractor: Any entity contracted to perform construction, demolition, excavation, repair, renovation, or similar work.
- Subcontractor: Any entity subcontracted by a contractor to perform such work.
Contractors are responsible for ensuring that any subcontractors they work with are properly registered.
Why Register Early?
The NYSDOL encourages contractors and subcontractors to register as soon as possible to avoid delays in bidding or project schedules.
