Book Law LLP recently hosted a webinar focused on the legal essentials for ABA (Applied Behavioral Analysis) therapy providers. We provided practical, real-world guidance on how employers can proactively manage risk and stay ahead of evolving employment regulations in a rapidly growing industry.

Book Law LLP Associate Charlotte Pramer and Partner Sheryl Galler led the discussion, walking through the complex employment law landscape that ABA therapy employers navigate every day. As the industry continues to expand, understanding compliance risks and implementing strong policies and practices is more important than ever.

During the session, we covered several key topics, including:

  1. Independent Contractor vs. Employee: The classification is not a choice, but a legal determination. Misclassification can lead to costly penalties, back wages, and legal disputes.
  2. Exempt vs. Non-Exempt: Employee’s actual job duties, not just their title, play a crucial role in the analysis.
  3. Wage & Hour Compliance: ABA providers face common challenges, particularly around non-billable time, travel time between clients, training and onboarding, mandatory breaks, and other compensable work time.
  4. Background Checks: Laws governing when and how background checks may be conducted must be balanced against regulations that require protections for children and vulnerable populations. These obligations extend beyond the hiring stage and can impact other areas of employment.
  5. Leaves & Benefits: ABA employers must comply with legal requirements and know how to recognize and properly respond to employee leave requests and frequently overlooked issues related to reasonable accommodations.
