Webinar Recap: Key Employment Law Considerations for Healthcare Employers

Book Law LLP recently presented a webinar on the legal essentials for healthcare employers. We focused on special considerations that arise for employers of health professionals who travel to patients to provide care.

Book Law LLP Partner Sheryl Galler walked through the laws employers need to know, highlighting their application to timekeeping and payment scenarios common in the industry.

During the session, Sheryl covered several key topics, including:

  1. Who is an Employee: The question sounds simple, but the answer can be complex. Misclassification can lead to costly penalties, back wages, and legal disputes.

  2. Wage & Hour Compliance: Healthcare employers face common challenges, particularly around timekeeping and pay for travel time between clients, training and onboarding, on-call time, split shifts, and off-the-clock work.

  3. Wage Deductions: What may sound reasonable to a business owner – deducting employee wages for uniforms, wage advances, traffic tickets, or broken equipment – may actually be a violation of federal and state wage laws.

  4. Leaves & Benefits: Employees may be out of sight, but that does not relieve employers of their obligation to provide mandatory leaves and benefits, properly respond to accommodation requests, and keep up with ever-changing leave requirements under state and local law.

  5. Recordkeeping and Wage Statements: These may be the least fun part of running a business, but they can help protect what you’ve built if you’re facing state agency audits or wage and hour claims.
