Spotlight on Sheryl Galler: AI and the Hiring Process
Our partner Sheryl Galler recently spoke about the use of AI in the hiring process and the legal implications, as a panelist on a program by the New York State Bar Association (NYSBA).
Sheryl noted that many applicants are using Generative AI to help generate resumes and practice for interviews, while many employers are using Generative AI to screen resumes and job applications. A growing number of employers have taken the process a step further and are using Generative AI to interview and assess job candidates.
It is well accepted, however, that AI has hidden biases and has the potential to discriminate against applicants based on protected categories such as race and gender. As a result, several states and New York City have proposed or enacted laws requiring bias audits of AI systems and transparency regarding their use. In addition, state attorneys general have reminded employers that discrimination is unlawful even if it is caused by AI or automated decision tools. Employers should protect themselves by developing and enforcing policies on using AI in hiring and employment decisions.
Sheryl was invited to speak due to her experience counseling clients on a wide range of Employment Law and compliance matters, and her leadership roles in the bar association.
Sheryl is a past chair of the NYSBA Labor and Employment Law Section and past chair of the NYSBA Women in Law Section. She has moderated and presented programs on Employment Law and professional practice for NYSBA and other organizations, and authored several publications on Employment Law topics.
